When I took the Oath of Office for the 171st Judicial Court 18 years ago, I took an oath to follow of laws of the State of Texas and the Constitution of the United States. Therefore, in each and every case, I focus on following the law, providing an equal playing field for all the litigants, respecting all that appear before me, and being fair and impartial.
As a council, all the judges have worked towards revamping the Indigency policy and procedures implemented in our courts, including the appointment of attorneys. It is the court's role to insure that a competent attorney is appointed to the indigent defendant as soon as possible to minimize incarceration as well as insure a zealous competent defense.
I will speak to the attorney privately, in chambers, regarding his/her allegations followed by a voluntary recusal from the case. It is my opinion that no judge should preside over a case where an attorney has questioned the integrity of a judge.
The above question involving the impugning of the judge's integrity mandates recusal, as well as being related by blood or marriage, either to the attorneys, their respective clients, or any witness in the case. In addition, if I cannot be fair and impartial due to a bias or previous experience, I recuse myself as well.
